H-1B Lottery Misconceptions, Have You Been Misled?

The H-1B lottery season is upon us again. Our law firm has also received many inquiries regarding the H-1B lottery. During our consultations, we discovered that clients actually have some common misconceptions about the H-1B lottery. Today, we are here to summarize these.
First Question
"My company is small. Does that mean we cannot apply for the lottery?"
Actually, the answer is no. The size of the company does not determine whether it can apply for the lottery. Every company can apply. However, the smaller the company, the harder it may be to get approval after winning the lottery when submitting the application. So, small companies can apply for the lottery, but the approval rate after winning needs to be discussed with a lawyer.
Second Question
"I am a part-time H-1B employee. Does that mean I cannot apply?"
No, both part-time and full-time H-1B applicants can apply for the lottery. There is no issue. We have also handled many part-time H-1B applications.
Third Question
"I am not currently working at this company. I work at company A. Can company B apply for the lottery for me?"
Yes. The H-1B application is based on your future employment situation after winning the lottery. It has nothing to do with your current job at company A or B. Even if you are not currently working at company B, they can still apply for the lottery for you. No problem.
Fourth Question
"If I win the H-1B lottery, can I transfer this winning slot to company B and have them submit the application for me?"
No. If company A applies for and wins the lottery for you, you must submit the H-1B application through company A. However, after your H-1B is approved and activated, we can submit an application to transfer you from company A to company B.
Final Question
"My company does not have E-Verify. Does that mean we cannot apply for the lottery?"
The answer is no. E-Verify is for employers of STEM OPT students and is not related to H-1B. So, even if the company does not support STEM OPT or does not use E-Verify, it does not mean they cannot apply for the lottery for you. They can still apply for H-1B.

第一个问题
我的公司是一个小公司,是不是就不能抽签了?
其实答案是否定的。公司的大小不决定它可不可以抽签,每一个公司都可以抽签。但是公司越小的话,我们抽中了之后去递交申请时,申请能不能获批是另外一回事。所以,小公司是可以抽签的,但是抽中了之后的获批率,需要和律师讨论。
第二个问题
我是 part-time 兼职的 H-1B,我是不是不能抽签?
不是的,兼职和全职的 H-1B 申请都是可以抽签的,没有问题。我们也做过非常多的兼职申请。
第三个问题
我现在不在这个公司工作,我在 A 公司工作,B 公司可不可以给我抽签?
可以的。H-1B 申请要求的是你抽中之后的未来工作情况,和你现在在 A 公司或 B 公司工作是没有关系的。即使你不在 B 公司工作,他们也可以帮你抽签,没有问题。
第四个问题
如果我 H-1B 抽中了,我能不能把这个中签的名额给到 B 公司,让 B 公司帮我递交申请?
是不可以的。如果 A 公司帮你抽中,你必须由 A 公司提交 H-1B 申请。当然,在 H-1B 批准并激活后,我们可以提交申请,把你从 A 公司转到 B 公司。
最后一个问题
我的公司没有 E-Verify,是不是就不能抽签了?
答案是否定的。E-Verify 主要针对的是 STEM OPT 雇主,和 H-1B 申请没有关系。所以,即使公司不支持 STEM OPT 或者没有 E-Verify,也不影响他们为你申请 H-1B。
