How to Check H-1B and Green Card Minimum wage requirements

Step One

We first go to the Department of Labor’s official website: dol.gov

On this website, go to the search box and type prevailing wage

Then an option will appear below, called Prevailing Wage Information and Resources

So we click on this link

After clicking this link, you’ll see a section called Filing Tools and Resources

There are several options below, and the one we choose is FLC Data Center / Online Wage Library

Alright, after opening this link, we are directly taken to the page for checking the wage levels

This page is divided into left and right sections

The left section is where you fill out information

The right section will display the minimum wage standards once you’ve entered all the information

We’ll start with the left section

The first section is called Select the Data Source

Here’s something to note: every year on July 1st, the Department of Labor updates the wage level standards

So in June, we need to pay extra attention

If your LCA or PERM application cannot be filed before June 30th, you’ll need to wait for the next wage level update

For example, if you are filing a case today, you should select the data source for July 2024 to June 2025

Next is Select a Collection

Here we usually choose All Industries

Next, we need to fill in the SOC Code section

Today we will use Market Research Analyst and Marketing Specialist as an example

You can enter the job title’s name, or its SOC Code

Here, we directly enter Market Research Analyst, and this option will appear

Next, you need to fill in the job location

One is the state where the job is located, and the other is the county

For example, using our law firm’s address: we are in New York, so we choose New York State

For the county, since we’re in New York County, we select New York

At this point, all the information is filled in, and we simply click Submit

Now you can see the minimum wage level standards appear on the right side

These wage levels are divided into multiple tiers, but one important thing to note: when you file your case, your wage must at least meet Level One

It can be hourly wage or annual salary

我们要先上劳工局的官方网站 dol.gov

这个网站上面去到他的查询框，输入 prevailing wage

下面会出现一种选项，叫做 Prevailing Wage Information and Resources

所以说我们要点开这个链接

点开这个链接之后，你会看到有一个 section 叫 Filing Tools and Resources

那下面还有好几个选项，我们要选的是 FLC Data Center / Online Wage Library

好了，打开这个链接之后，我们就直接跳转到了如何去查这个 wage level 的页面

这个页面分左边和右边

左边这部分是需要大家填写信息的

右边这部分是大家填写完信息之后，劳工局最低工资标准就会显示在右边部分

我们先从左边部分来看

第一个 section 叫 Select the Data Source

里边大家需要注意的一点是劳工局每年 7 月 1 号 会更新工资等级的水平

所以说我们在 6 月份的时候一定要特别注意

如果说 6 月 30 号之前你的 LCA 或者 PERM 申请不能提交，那你就需要等待下一个工资等级的更新

比如说今天你要提交一个案子，那你要选择的选项是 2024 年 7 月到 2025 年 6 月 这个 data source

接下来是选择 Select a Collection

这里边我们通常会选 All Industries

接下来是我们要填写 SOC Code 的地方

今天我会拿 Market Research Analyst and Marketing Specialist 来作为一个例子

大家可以填写这个 title 的名字，或者说是它的 SOC Code

那这里我们就直接填写 Market Research Analyst，它就会出现这个选项了

接下来这个部分，大家需要填写工作的地点

一个是工作的州，一个是具体的 county（郡）

比如我以我们律所的地址为例，我们律所在纽约，所以州选 New York

我们的 county 也是在 New York County，所以我会填写 New York

这个时候我们所有信息填写好了，就直接点击 Submit

这时候大家可以看到，右手边部分的最低工资等级的标准已经出来了

这个工资等级有多个级别，但是大家需要注意的是，你提交申请的时候，你的工资必须至少达到 Level 1

可以是 时薪，也可以是 年薪
