Marriage-Based Green Card RFE? Just Because These Were Missing

For marriage-based green cards, if the marriage has lasted for less than two years, USCIS will issue a conditional green card that is valid for two years.

However, when the two-year green card is about to expire, you need to submit Form I-751 to remove conditions and obtain a permanent green card.

Recently, a client contacted our firm, and we discovered that many clients have a common misconception.

They believe that the I-751 application is a simple process, requiring only the form to be filled out. Since they already submitted proof of their marriage’s authenticity when applying for the conditional green card, and USCIS had reviewed it, they think they don’t need to submit it again.

Many clients share this misunderstanding, which often results in USCIS issuing a Request for Evidence (RFE).

When reviewing the I-751 application, USCIS primarily assesses whether the marriage has remained genuine over the past two years, so supporting documents from the two-year marriage period must be provided.

This particular client only sought our assistance after receiving an RFE.

After thorough communication with the client, we provided substantial evidence to demonstrate that their marriage over the past two years was indeed legitimate.

For example:

Evidence of their travels together

Photos taken over the past two years

Text message exchanges between them

Sworn statements from friends supporting their case

In the end, we submitted approximately 200 pages of documentation to USCIS, hoping that the case will be successfully approved.
