H-1B Approval: H-1B Employees Working from Home? No Problem! All Approved!

Today I want to share with you this approval case, which is this year's initial H-1B approval without a Request for Evidence (RFE). The main reason we want to share this case is because all of this company's employees are 100% work from home.


Actually, preparing a case like this does carry some risk, because we have to prove to the USCIS that the relationship between the employer and employee is a legal employment relationship. So, after communicating with both the employer and the employee, we provided the corresponding explanation.


Fortunately, our explanation was very thorough, and the USCIS officer had no doubts about this case. In fact, this company had two employees that were selected by this year's H-1B lottery, and both of these selected employees' cases got direct approval without RFE.
