我们在过户的时候,经常会遇到一个词叫远程过户(Remote Closing)。

当我们跟买家过合同的时候,当我们跟买家解释远程过户的时候,他们就会有无数的问题问我们。所以我们来做个解答。


什么是 Remote Closing?

Remote Closing 的意思就是过户的时候,你看不到卖家律师,也看不到卖家,这就叫远程过户。


这主要是疫情时期的产物,在疫情之后,很多卖家律师也延续了这个远程过户的做法。


买家能不能 Remote Closing?

很多买家会问:卖家可以远程过户,那我可不可以也远程过户?


其实是不可以的。


因为买家在过户的时候,需要签署所有的文件,而且需要做公证。所以一般情况下,产权公司会派一个产权负责人(Title Closer) 过来,他会监督你签字,并给你公证。


银行也会带来所有需要的文件,我们还需要对银行文件进行公证。


因此,买家需要签署的文件很多,需要公证的文件也很多,所以远程过户一般只适用于卖家,不适用于买家。


买家仍然需要亲自到买家律师办公室或者银行律师办公室进行过户。


如果买家无法亲自过户怎么办?

如果买家无法亲自到场过户,就需要签署 Power of Attorney(委托授权书),授权律师代为签字和完成过户手续。

When we go through the closing process, we often encounter a term called Remote Closing.

When we go over the contract with the buyer and explain remote closing, they have countless questions for us. So, let’s provide some answers.


What is Remote Closing?

Remote closing means that during the closing process, you won’t see the seller’s attorney or the seller. This is what we call remote closing.


It is mainly a product of the pandemic. After the pandemic, many seller’s attorneys have continued this remote closing practice.


Can Buyers Do Remote Closing?

Many buyers ask: The seller is doing a remote closing, can I also do a remote closing?


The answer is no.


During the closing, the buyer needs to sign all documents and have them notarized. Generally, the title company will send a Title Closer, who will watch the buyer sign the documents and notarize them.


The bank will also bring all the necessary documents, and we need to notarize bank documents as well.


Since the buyer has many documents to sign and notarize, remote closing is generally only applicable to sellers, not to buyers.


Buyers still need to go to the buyer’s attorney’s office or the bank’s attorney’s office in person for closing.


What If the Buyer Cannot Be Present for Closing?

If the buyer cannot be present, they need to sign a Power of Attorney, which authorizes an attorney to sign and close on their behalf.
