纽约买房当天过户+当天搬家?小心这些坑!

大家好,


在纽约购买新房,很多客户会问我们一个问题:我可不可以上午完成过户,下午就搬家?


其实理论层面上是可以的,但是在现实层面上,我们并不建议这么做。原因有以下几点:


第一点,纽约大部分的新房买卖中,开发商的律师是不到场的。那么我们要怎么把钱给到对方律师呢?一般需要去银行做 wire(电汇),这和银行支票不同,不能做到一手交支票、一手交钥匙。


通常情况是我们去银行柜台完成电汇后,对方律师要等确认到账,才会说“OK,你可以去取钥匙了”。


但我们也知道,有些客户即使在上午完成汇款,由于银行内部的层层审核,也不一定能在当天到账。这种情况下,就有可能当天下不了钥匙。


如果你已经安排好搬家公司,他们在现场等着,但因为你拿不到钥匙,他们也进不去,就会面临只能改到第二天搬家的问题。


第二个原因是,我们在购买新房时通常会进行一次屋检,随后形成一个尾项清单。在某些特殊情况下,买卖双方可能对哪些项目应列入尾项清单、哪些需要修复达不成一致,这就需要双方律师和经纪人进行协调。


这类协商一般应在过户前完成,但也有情况是在过户当天仍在谈。如果我们到上午11点还在谈要不要把某项放上去,而你这边搬家公司已经等着搬家了,你可能会说“算了”,选择放弃一些本可以争取的事项,只为了尽快拿到钥匙。这会让你在谈判中处于不利位置。


第三个原因是,在美国搬家通常需要提前预约电梯,并将搬家公司的保险文件提供给大楼管理。有些客户不了解这些规定,以为可以上午搬家下午入住。但如果你没有提前预约电梯、没有提交保险,就算把家具运来了,大楼也不会让你搬进去。


所以,如果真的要下午搬家,一定要提前把公寓需要的所有材料都准备好、交齐,才能确保顺利搬入。

Hello everyone,


When buying a new home in New York, many clients ask us the same question:

Can I complete the closing in the morning and move in the afternoon?


In theory, it’s possible — but in reality, we do not recommend it. There are several reasons why:


First, in most new home purchases in New York, the developer’s attorney is not present at the closing. So how do we transfer the money to the seller’s attorney? It usually requires a wire transfer at the bank. Unlike handing over a certified check, we can’t just exchange the check for the keys on the spot.


Typically, after we complete the wire transfer at the bank, the seller’s attorney needs to confirm receipt of the funds before they will say, “OK, you can go pick up the keys now.”


However, even if the client wires the funds in the morning, due to layers of internal banking review, the money may not arrive on the same day. That means you might not get the keys on the day of closing.


If you already have a moving company waiting outside, and you don’t have the keys, they won’t be able to enter. You may have to delay the move until the next day.


Second, when purchasing a new home, we usually conduct a home inspection, which results in a punch list of items that need fixing. In some special cases, the buyer and seller may not agree on what should be on the punch list or what needs to be repaired. This requires further negotiation between attorneys and agents on both sides.


While this is usually resolved before the closing, there are cases where both parties are still negotiating at the closing table. If you're still negotiating at 11 AM and your movers are already waiting, you might feel pressured to give up on some issues just to get the keys and move in. This weakens your position during negotiation.


Third, when moving in the U.S., you usually need to reserve the elevator in advance and provide your moving company’s insurance to the building management.


Some clients are unaware of these rules and assume they can just move in on the same day. But if the elevator hasn't been reserved or the insurance hasn’t been submitted, even if the furniture is ready, the building might not let you move in.


So, if you plan to move in the afternoon, you must prepare in advance and submit all required documents to the building. Only then can you ensure a smooth move-in.
